The Vietnamese government has issued Resolution 44/2026/NQ-CP to address challenges in implementing electronic labor contracts under Decree No. 337/2025/ND-CP. The resolution, signed on October 30, 2026, provides a grace period for service providers to connect to the official Electronic Labor Contract Platform, while also ensuring continuity in service delivery during the transition. This follows the Government’s Decree No. 337/2025/ND-CP, which established the legal framework for electronic labor contracts as part of broader digital transformation efforts under the Law on E-Transactions No. 20/2023/QH15.
According to the new rules, an eContract Provider offering electronic labor contract services before July 1, 2026, but not yet connected to the platform by that date may continue providing services until December 31, 2026. Electronic labor contracts concluded during the connection-pending period shall have the same validity as paper contracts, and shall be performed in accordance with labor law and the law on e-transactions until the expiration of such contracts. The Ministry of Home Affairs will oversee the assignment of identification numbers to these contracts, ensuring compliance with the existing system for contracts signed before July 1, 2026. This approach maintains legal certainty while allowing providers additional time to meet technical and procedural requirements.
The contracts signed before full connection will receive ID numbers in the same manner as those created before July 1, 2026, with the Ministry of Home Affairs guiding the process. From January 01, 2027, the conclusion of electronic labor contracts must satisfy the conditions and methods specified in Article 6 of the Government’s Decree No. 337/2025/ND-CP dated December 24, 2025. These provisions align with the Labor Code No. 45/2019/QH14, reinforcing the legal basis for electronic contracts in employment relationships.
The official operation of the Electronic Labor Contract Platform is suspended until a provider meets the requirements in Clause 3, Article 6 of the decree and completes the connection procedures, which include technical compatibility tests and data security certifications. However, the Electronic Employment Contract Platform must commence official operation no later than December 15, 2026. This deadline ensures that the digital infrastructure is fully operational before the transition period for providers ends on December 31, 2026.
