This Week in the Supreme Court – Week commencing 7th November 2022 – UKSCBlog

On Tuesday 8th November the Court will hear the case Sara & Hossein Asset Holdings Ltd (a company incorporated in the British Virgin Islands) v Blacks Outdoor Retail Ltdon appeal from [2020] EWCA Civ 1521. The hearing will be at 10:30 in Courtroom Two and will consider whether the Court of Appeal erred in its construction of a provision in a commercial lease concerning service charges.

On Wednesday 9th November the Court will hear R (on the application of Pearce and another) v Parole Board of England and Wales, on appeal from [2020] EWHC 798. The hearing will be at 10:30 in Courtroom 2. The Court will consider two issues: (1) When the Parole Board assesses the risk to the public arising from the potential release of a prisoner, can it only take into account allegations if they are proved on the balance of probabilities? (2) Does the Parole Board’s “Guidance on Allegations” (the Guidance) misstate the law on this issue?
